The special prosecutor’s records sealed the contents of the court’s ruling confirming his January 6 case against Trump

Special Counsel Jack Smith’s lengthy letters seeking to justify his latest indictment of former President Donald Trump on allegations that he tried to disrupt the 2020 election have been sealed from U.S. District Judge Tanya Chutkan, a spokeswoman for Smith’s office confirmed to ABC News Thursday.

“We have complied with the court’s order,” spokesman Peter Carr said.

The article presents Smith’s argument regarding the application of the Supreme Court’s ruling on presidential immunity to the former president’s criminal case.

Whether any part of the records will be made public is now up to Judge Chutkan.

Smith also submitted a proposed redacted version of the filing, which his office said was appropriate for public release.

Trump’s defenders will have a chance to present their own counter-arguments opposing the release of the information contained in the file.

Chutkan on Tuesday granted Smith’s request to file a more than 180-page brief, exceeding the standard limit of 45 pages.

In July, the Supreme Court ruled in a controversial decision that Trump was entitled to immunity from criminal prosecution for official acts committed while in office, effectively sending the case back to Chutkan to determine what charges Trump could face.

Smith then charged Trump in a new indictment with the same election interference crimes as in the original indictment, but it was watered down and brought in line with the Supreme Court’s ruling on presidential immunity.

Chutkan then ruled that Smith could file extensive documents to support his presidential immunity arguments.
