On Monday, September 16, lawyers for the 23-year-old Olympic gold medalist filed an appeal on behalf of Chiles to the Federal Supreme Court of Switzerland to overturn the decision of the Court of Arbitration for Sport (CAS) that stripped the athlete of her bronze medal in women’s floor gymnastics at the 2024 Paris Olympics, according to a press release. The bronze medal was awarded to Romanian gymnast Ana Bărbosu.

“CAS violated Chiles’ fundamental right to be heard by refusing to consider video evidence that showed her request was filed in a timely manner — in direct contradiction with the findings in the CAS decision,” her lawyers argued in a press release.

Chiles’ lawyers argue that Chiles was never properly informed that CAS President Hamid G. Gharavi had a “serious conflict of interest,” the press release states. Gharavi had acted as Romania’s adviser for nearly a decade and was actively representing Romania at the time of the incident, Chiles’ lawyers said.

“Jordan Chiles’ appeals present the international community with a simple legal question: Will everyone stand by while an Olympian who did the right thing is stripped of her medal because of a fundamental injustice in the summary arbitration process? The answer to that question should be no. Every part of the Olympic Games, including the arbitration process, should be fair play,” said Maurice M. Suh, Chiles’ lawyer.

The United States Olympic and Paralympic Committee (USOPC) filed a letter supporting Chiles’ appeal, her attorneys said in a press release.

USA Gymnastics said in a statement Monday it supported Chiles’ appeal.

“USA Gymnastics supports the appeal filed today by Jordan Chiles in the Swiss Federal Court of Justice, as we made a mutual, strategic decision to have Jordan lead the initial trial,” the statement read. “USA GA is working closely with Jordan and her legal team and will file supportive motions with the court to continue to pursue justice for Jordan.”

Chiles, who won the gold medal as a member of Team USA on July 30 in the women’s artistic all-around competition, competed in the individual free exercise competition on August 5. Chiles initially placed fifth, but her coach appealed due to a scoring error. After the Romanian gymnasts appealed to CAS, the International Olympic Committee ordered Chiles to return her bronze medal on August 11.

CAS argued that the gymnast’s coach was four seconds late in asking to correct her score from 13.766 to 13.666. Chiles disputed that finding, “even submitting a video recording that unequivocally proves that the request was made on time,” her lawyers said in a press release.

On August 15, Chiles posted a statement on her Instagram account, breaking her silence after her bronze medal was stripped following protests and appeals by the Olympic committees.

“While I was celebrating my Olympic achievements, I heard the devastating news that my bronze medal had been stripped,” the gymnast began.

Chiles said she “had confidence in the appeal filed by USAG, which presented compelling evidence that my result was in accordance with all the rules.” However, “that appeal was ultimately unsuccessful.”

“I am speechless. This decision seems unfair and is a serious blow not only to me but to all those who have supported my journey,” Chiles said, among others.
